Foreclosure Administrative Order-10-22-2024

Each of the eight Residential Foreclosure Divisions will be presided over by the corresponding Circuit Civil Division Judge. For example: Division FC-A will be presided over by the Circuit Civil Judge assigned to Division CV-A.

Foreclosure Divisions designation:
Each division designation (FC-A, FC-B, FC-C, FC-D, FC-E, FC-F, FC-G, FC-H, and FC-I) shall be included on all emails, pleadings, motions, notices, proposed orders and cover letters.

 

COMMUNICATIONS WITH THE COURT:

For Divisions FC-A, FC-C, FC-D, FC-E, FC-F, FC-G, and FC-I communications with the Court regarding scheduling of hearings, submission of proposed orders, motions (emergency) to cancel sales and other matters regarding residential foreclosure cases shall be made to:

PROCEEDINGS:

Residential foreclosure proceedings are conducted in Courtroom 510 of the Duval County Courthouse.

CASE MANAGEMENT CONFERENCES:

The Foreclosure Case Management Office will routinely schedule Case Management Conferences (“CMC”) pursuant to Rule 1.200(a), Fla. R. Civ. P. At a CMC the Court will address any noticed uncontested motions, consent motions, or motions requiring five (5) minutes or less time to address. 

Additional motions may NOT be added without approval from the Foreclosure Case Management Office.

HEARING DATES:

Hearing dates will be provided but are NOT secured until confirmation is sent. Until the parties have agreed on a date, hearing dates provided are NOT held and may be given to others.

CONSENT/UNCONTESTED MOTIONS:

Many uncontested motions do not need to be set for a hearing. Such matters may include motions to appoint a GAL, amend the complaint or other pleading, grant leave for or facilitate service of process, or schedule or cancel a sale. Motions to Disburse Surplus Proceeds should normally be noticed for hearing.

PROPOSED ORDER SUBMISSIONS:

Submission of proposed orders shall be made through the State of Florida’s e-filing portal or emailed to the Foreclosure Case Manager at DuvalFC@coj.net.

ALL PROPOSED ORDERS MUST INCLUDE THE FOLLOWING:

All proposed orders shall include the following language as the last paragraph of the order before DONE and ORDERED, “Counsel for Plaintiff shall serve a copy of this Order, by regular mail, to all parties not receiving service of court filings through the Florida Courts E-Filing Portal and shall file a Notice of Service in the court file.”

When an order is entered by the Court, the Court will e-file the Order, which will be provided to counsel through the e-portal. It is counsel for Plaintiff’s responsibility to serve copies, by regular mail, to all parties that are not served through the e-filing portal and file a Notice of Service in the court file.

  1. A cover letter indicating what the Order is for... i.e. hearing (including the hearing date), dismissal, consent order, etc. The cover letter should also indicate if it is consented to or objected, and that all parties are copied with same. The Order only should be in Word format. PLEASE DO NOT PROVIDE PROPOSED ORDERS THROUGH THE E-PORTAL AND BY EMAIL. Sending it both ways may cause duplication.
  2. A consented or agreed to order should have in the caption “Consent” or “Agreed”, or it should have both or all parties’ signatures.
  3. Service list should contain appropriate email or USPS addresses for all parties to be copied on.
  4. When a Proposed Order has been submitted and there are unrepresented parties not receiving service through the e-portal, the attorney submitting the order is responsible for mailing copies to any and all non-represented parties and filing a Notice of Service in the case.

COURTESY COPIES:

Notice of Hearings should be filed with the Clerk of Court and appear on the docket prior to the hearing date. If counsel would like the Judge to have courtesy copies for a hearing, motions, memorandum of law, or case law hard copies should be inside the Courthouse at least three to five business days prior to the scheduled hearing date. Please provide hard copies via U.S. mail, FedEx, UPS, or hand delivery. Hard copies can be mailed to the following address:
